Y\u00fcr\u00fcrl\u00fckteki d\u00fczenlemeye g\u00f6re \u015fu durumlarda i\u015f\u00e7i kiralanabilmektedir: Do\u011fum yapan kad\u0131n\u0131n k\u0131smi s\u00fcreli \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya \u00fccretsiz izinli oldu\u011fu d\u00f6nemde; i\u015f\u00e7inin askerlik hizmeti h\u00e2linde ve i\u015f s\u00f6zle\u015fmesinin ask\u0131da kald\u0131\u011f\u0131 di\u011fer h\u00e2llerde; mevsimlik tar\u0131m i\u015flerinde; ev hizmetlerinde; i\u015fletmenin g\u00fcnl\u00fck i\u015flerinden say\u0131lmayan ve aral\u0131kl\u0131 olarak g\u00f6rd\u00fcr\u00fclen i\u015flerde; i\u015f sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi bak\u0131m\u0131ndan acil olan i\u015flerde veya \u00fcretimi \u00f6nemli \u00f6l\u00e7\u00fcde etkileyen zorlay\u0131c\u0131 nedenlerin ortaya \u00e7\u0131kmas\u0131 h\u00e2linde; i\u015fletmenin ortalama mal ve hizmet \u00fcretim kapasitesinin ge\u00e7ici i\u015f ili\u015fkisi kurulmas\u0131n\u0131 gerektirecek \u00f6l\u00e7\u00fcde ve \u00f6ng\u00f6r\u00fclemeyen \u015fekilde artmas\u0131 h\u00e2linde; mevsimlik i\u015fler hari\u00e7 d\u00f6nemsellik arz eden i\u015f art\u0131\u015flar\u0131 h\u00e2linde.<\/p>\n<p style=\"text-align: justify;\">Say\u0131n Akkol, di\u011fer konularda da i\u015f\u00e7i kiralanabilmesini istemektedir.<\/p>\n<p style=\"text-align: justify;\">Yasaya g\u00f6re, i\u015f\u00e7i kiralama 4 ay s\u00fcreyledir. Bu s\u00fcre, toplam sekiz ay\u0131 ge\u00e7memek \u00fczere en fazla iki defa yenilenebilir. &#8220;Ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ran i\u015fveren, belirtilen s\u00fcrenin sonunda ayn\u0131 i\u015f i\u00e7in alt\u0131 ay ge\u00e7medik\u00e7e yeniden ge\u00e7ici i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131ramaz.&#8221;<\/p>\n<p style=\"text-align: justify;\">Bu k\u0131s\u0131tlaman\u0131n da kald\u0131r\u0131lmas\u0131 talep edilmektedir.<\/p>\n<p style=\"text-align: justify;\">TELAF\u0130 \u00c7ALI\u015eMA S\u00dcRES\u0130<\/p>\n<p style=\"text-align: justify;\">T\u0130SK Y\u00f6netim Kurulu Ba\u015fkan\u0131 Akkol, bir\u00e7ok i\u015fverenin, y\u00fcr\u00fcrl\u00fckteki Yasada 2 ay olan telafi \u00e7al\u0131\u015fma s\u00fcresinin k\u0131sal\u0131\u011f\u0131ndan yak\u0131nd\u0131\u011f\u0131n\u0131 belirterek, &#8220;Telafi \u00e7al\u0131\u015fma s\u00fcresi 6 aya \u00e7\u0131kar\u0131lmal\u0131, i\u015f\u00e7i onay\u0131 aranmamal\u0131, \u00e7al\u0131\u015f\u0131lmayan cumartesi g\u00fcnlerinde telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131r\u0131labilmelidir&#8221; talebini g\u00fcndeme getirdi.<\/p>\n<p style=\"text-align: justify;\">\u0130\u015f Kanununa g\u00f6re, &#8220;Zorunlu nedenlerle i\u015fin durmas\u0131, ulusal bayram ve genel tatillerden \u00f6nce veya sonra i\u015fyerinin tatil edilmesi veya benzer nedenlerle i\u015fyerinde normal \u00e7al\u0131\u015fma s\u00fcrelerinin \u00f6nemli \u00f6l\u00e7\u00fcde alt\u0131nda \u00e7al\u0131\u015f\u0131lmas\u0131 veya tamamen tatil edilmesi ya da i\u015f\u00e7inin talebi ile kendisine izin verilmesi hallerinde, i\u015fveren iki ay i\u00e7inde \u00e7al\u0131\u015f\u0131lmayan s\u00fcreler i\u00e7in telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131rabilir. Bu \u00e7al\u0131\u015fmalar fazla \u00e7al\u0131\u015fma veya fazla s\u00fcrelerle \u00e7al\u0131\u015fma say\u0131lmaz. Telafi \u00e7al\u0131\u015fmalar\u0131, g\u00fcnl\u00fck en \u00e7ok \u00e7al\u0131\u015fma s\u00fcresini a\u015fmamak ko\u015fulu ile g\u00fcnde \u00fc\u00e7 saatten fazla olamaz. Tatil g\u00fcnlerinde telafi \u00e7al\u0131\u015fmas\u0131 yapt\u0131r\u0131lamaz&#8221;. (M.64)<\/p>\n<p style=\"text-align: justify;\">Say\u0131n Akkol\u2019un bu talebi de i\u015f\u00e7i haklar\u0131nda bir gerilemeyi ama\u00e7lamaktad\u0131r.<\/p>\n<p style=\"text-align: justify;\">KISA \u00c7ALI\u015eMA \u00d6DENE\u011e\u0130<\/p>\n<p style=\"text-align: justify;\">\n<p style=\"text-align: justify;\">Say\u0131n Akkol, &#8220;K\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi i\u00e7in belirlenen 3 ayl\u0131k s\u00fcre yetersizdir. K\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi s\u00fcresi en az 6 aya \u00e7\u0131kar\u0131lmal\u0131d\u0131r&#8221; g\u00f6r\u00fc\u015f\u00fcn\u00fc payla\u015ft\u0131.<\/p>\n<p style=\"text-align: justify;\">4447 say\u0131l\u0131 Kanuna g\u00f6re, &#8220;genel ekonomik, sekt\u00f6rel veya b\u00f6lgesel kriz ile zorlay\u0131c\u0131 sebeplerle i\u015fyerindeki haftal\u0131k \u00e7al\u0131\u015fma s\u00fcrelerinin ge\u00e7ici olarak \u00f6nemli \u00f6l\u00e7\u00fcde azalt\u0131lmas\u0131 veya i\u015fyerinde faaliyetin tamamen veya k\u0131smen ge\u00e7ici olarak durdurulmas\u0131 hallerinde, i\u015fyerinde \u00fc\u00e7 ay\u0131 a\u015fmamak \u00fczere k\u0131sa \u00e7al\u0131\u015fma yap\u0131labilir. (&#8230;) K\u0131sa \u00e7al\u0131\u015fma halinde \u0130\u015fsizlik Sigortas\u0131 Fonundan k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi \u00f6denir. (&#8230;) G\u00fcnl\u00fck k\u0131sa \u00e7al\u0131\u015fma \u00f6dene\u011fi; sigortal\u0131n\u0131n son oniki ayl\u0131k prime esas kazan\u00e7lar\u0131 dikkate al\u0131narak hesaplanan g\u00fcnl\u00fck ortalama br\u00fct kazanc\u0131n\u0131n % 60\u2019\u0131d\u0131r&#8221;.<\/p>\n<p style=\"text-align: justify;\">Say\u0131n Akkol, bu s\u00fcrenin en az 6 aya \u00e7\u0131kar\u0131lmas\u0131n\u0131 istemektedir.
