Maddesi ile kamu i\u015fyerlerindeki ta\u015feron i\u015f\u00e7ilerinin toplu i\u015f s\u00f6zle\u015fmelerinden yararlanmalar\u0131na y\u00f6nelik olarak getirilen yasaklar, ta\u015feron uygulamas\u0131 \u00f6rg\u00fctl\u00fcl\u00fc\u011f\u00fc zay\u0131flat\u0131rken, toplu i\u015f s\u00f6zle\u015fmelerin kapsam maddesinde de \u00f6nemli bir sorun olmaktad\u0131r. Kapsam maddesiyle, \u00e7al\u0131\u015fan i\u015f\u00e7ilerin \u00f6nemli bir b\u00f6l\u00fcm\u00fcn\u00fcn yararlanmamas\u0131 i\u00e7in, i\u015fveren taraf\u0131ndan yo\u011fun bir bask\u0131 uygulanmaktad\u0131r. Bu nedenle, her d\u00f6nem taslak \u00e7al\u0131\u015fmalar\u0131m\u0131zda kapsam maddesi b\u00fcy\u00fck \u00f6nem ta\u015f\u0131makta ve yararlanan i\u015f\u00e7i say\u0131s\u0131n\u0131n artmas\u0131 i\u00e7in b\u00fcy\u00fck bir \u00e7aba g\u00f6sterilmektedir.<\/p>\n\n<p style=\"text-align: justify;\">Sendikam\u0131z Belediye-\u0130\u015f toplu i\u015f s\u00f6zle\u015fmesi \u00e7al\u0131\u015fmalar\u0131nda, \u015fubelerimiz ile birlikte koordineli \u00e7al\u0131\u015f\u0131lmakta, her a\u015famada bilgi sa\u011flanmaktad\u0131r. \u00c7ok say\u0131da i\u015fyeri ve i\u015fletme toplu i\u015f s\u00f6zle\u015fmesi haz\u0131rl\u0131\u011f\u0131 yap\u0131ld\u0131\u011f\u0131ndan, b\u00fcrolar\u0131m\u0131z vas\u0131tas\u0131yla her t\u00fcrl\u00fc destek verilmektedir. Toplu i\u015f s\u00f6zle\u015fme g\u00f6r\u00fc\u015fmelerinde ise, y\u00f6neticiler olarak sorumlulu\u011fumuz gere\u011fi g\u00f6r\u00fc\u015fmelerin her a\u015famas\u0131nda yer alarak bar\u0131\u015f\u00e7\u0131l \u00e7\u00f6z\u00fcm yolu olan anla\u015fman\u0131n masada sonu\u00e7lanmas\u0131 i\u00e7in her t\u00fcrl\u00fc \u00e7aba g\u00f6sterilmektedir. \u0130\u015fyerlerimizin b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc korumak ve ortak hareket edilmesine yard\u0131mc\u0131 olmak i\u00e7in her d\u00f6nem taslak \u00e7al\u0131\u015fmalar\u0131nda \u00fccret ve sosyal yard\u0131mlara ili\u015fkin olarak \u00f6neriler haz\u0131rlanmaktad\u0131r. Toplu i\u015f s\u00f6zle\u015fmelerin uyu\u015fmazl\u0131k s\u00fcrecinde, Belediye Ba\u015fkanlar\u0131yla yap\u0131lan g\u00f6r\u00fc\u015fmelerde hakl\u0131l\u0131\u011f\u0131m\u0131z \u00e7ok ayr\u0131nt\u0131l\u0131 anlat\u0131lmakta ve uzla\u015fma zemini aranmaktad\u0131r.<\/p>\n\n<p style=\"text-align: justify;\">Uzla\u015fma olmamas\u0131 durumunda \u00fc\u00e7 a\u015famal\u0131 olarak Y\u00fcksek Hakem Kurulu\u2019na ba\u015fvurulmaktad\u0131r. Birincisi, grev yasa\u011f\u0131na g\u00f6re 2822 say\u0131l\u0131 Kanun\u2019un 32. Maddesi, \u00f6zel hakem olarak 58. madde veya grev oylamas\u0131 sonucuna g\u00f6re 36. Madde h\u00fck\u00fcmlerine g\u00f6re Y\u00fcksek Hakem Kurulu\u2019na uyu\u015fmazl\u0131klar\u0131n sonu\u00e7lanmas\u0131 i\u00e7in ba\u015fvurulmaktad\u0131r. Y\u00fcksek Hakem Kurulu kendi ilkeleri ve taraflar\u0131n taleplerini birlikte de\u011ferlendirerek karar vermektedir. Uyu\u015fmazl\u0131k konular\u0131yla ilgili olarak i\u015f\u00e7i temsilcileriyle her t\u00fcrl\u00fc bilgi al\u0131\u015f veri\u015fi sa\u011flanmakta taleplerimiz anlat\u0131lmaktad\u0131r.<\/p>\n\n<p style=\"text-align: justify;\">Sendika olarak toplu i\u015f s\u00f6zle\u015fmelerin taraflar aras\u0131nda sonu\u00e7lanmas\u0131n\u0131 benimsememize ra\u011fmen baz\u0131 belediyelerin veya i\u015fveren vekillerinin olumsuz yakla\u015f\u0131m\u0131 sonucu, kanun gere\u011fi uyu\u015fmazl\u0131lar Y\u00fcksek Hakem Kurulu\u2019na intikal ettirilmektedir. Toplu \u0130\u015f S\u00f6zle\u015fmesi, Grev ve Lokavt Kanunu genel olarak, \u00e7al\u0131\u015fanlar\u0131 koruyucu nitelikte bir i\u015fleve sahip de\u011fildir. Grev yasaklar\u0131n\u0131n yayg\u0131n olmas\u0131, H\u00fck\u00fcmetin grev hakk\u0131n\u0131 kullanma s\u00fcrecinde ertelemeye gitmesi, i\u015fveren taraf\u0131n\u0131 daha g\u00fc\u00e7l\u00fc k\u0131lmakta, i\u015f\u00e7i sendikas\u0131n\u0131n taleplerinin de\u011ferlendirilmesinde gerekli olan alt yap\u0131y\u0131 ve katk\u0131y\u0131 tam olarak sa\u011flayamamaktad\u0131r. Belediye-\u0130\u015f Sendikas\u0131 ola\u011fan\u00fcst\u00fc d\u00f6nemlerin \u00fcr\u00fcn\u00fc olan bu ve benzer yasalar\u0131, tek tarafl\u0131 haz\u0131rlanm\u0131\u015f olmas\u0131 ve geni\u015f kitleleri kapsamamas\u0131 ba\u011flam\u0131nda yetersiz g\u00f6rmektedir.<\/p>\n\n<p style=\"text-align: justify;\">Sendikam\u0131z \u00e7al\u0131\u015fanlar\u0131n insan onuruna yara\u015f\u0131r bir hayat s\u00fcrmelerine imkan verecek uygun bir \u00fccretle \u00e7al\u0131\u015fmalar\u0131n\u0131, ilgili yasalar\u0131n i\u015f g\u00fcvencesi konusunda verdi\u011fi haklar\u0131n \u00f6tesinde, \u00f6zellikle geli\u015fmi\u015f toplumlar\u0131n kabul etti\u011fi esaslara uygun olarak, gelece\u011fe g\u00fcvenle bakmalar\u0131n\u0131 ve i\u015fsizlik korkusundan uzak bir ya\u015fam s\u00fcrd\u00fcrmelerini sa\u011flamay\u0131 ama\u00e7 edinmi\u015ftir. Bununla birlikte, \u00e7al\u0131\u015fanlar\u0131n k\u00fclt\u00fcrel ve sosyal durumlar\u0131n\u0131n geli\u015ftirilmesine imkan verecek \u00f6l\u00e7\u00fcde, \u00e7al\u0131\u015fma saatlerinin k\u0131salt\u0131lmas\u0131, y\u0131ll\u0131k \u00fccretli izin s\u00fcrelerinin uzat\u0131lmas\u0131 konusunda gerekli maddelerin Toplu \u0130\u015f S\u00f6zle\u015fmelerine konulmas\u0131 hususlar\u0131nda m\u00fccadeleyi g\u00f6rev bilmi\u015ftir. Belediye-\u0130\u015f Sendikas\u0131, \u0130\u015f g\u00fcvenli\u011fi ve i\u015f\u00e7i sa\u011fl\u0131\u011f\u0131n\u0131n \u00f6nemine binaen, emek\u00e7ilerin \u00e7al\u0131\u015fma ko\u015fullar\u0131n\u0131n iyile\u015ftirilmesini ve gerekli her t\u00fcrl\u00fc koruyucu \u00f6nlemin al\u0131nmas\u0131n\u0131 vazge\u00e7ilmez ilkeler olarak kabul etmi\u015ftir.<\/p>\n\n<p style=\"text-align: justify;\">\u0130\u015fverenle olan ili\u015fkilerin medeni \u00f6l\u00e7\u00fcler i\u00e7erisinde ve i\u015f bar\u0131\u015f\u0131na hizmet eder \u015fekilde y\u00fcr\u00fct\u00fclmesine \u00f6zen g\u00f6steren Belediye\u2013\u0130\u015f Sendikas\u0131, Toplu \u0130\u015f s\u00f6zle\u015fmelerinin temellerinin belirlenmesinde, \u00fcyelerinin haklar\u0131n\u0131n ve \u00e7\u0131karlar\u0131n\u0131n, bir arada olman\u0131n verdi\u011fi g\u00fc\u00e7le, sonuna kadar savunulmas\u0131 i\u00e7in her d\u00fczeyde m\u00fccadeleyi esas al\u0131r.
